1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and ClearMakaan ("ClearMakaan", "we", "us", or "our"), governing your access to and use of the website located at www.clearmakaan.com (the "Platform").

By accessing, browsing, or using the Platform in any manner, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Platform.

2. Nature of the Platform — Information and Advertisement Marketplace

ClearMakaan operates as an online real estate information and advertisement marketplace. The Platform displays residential and commercial projects registered under the Real Estate (Regulation and Development) Act, 2016 ("RERA") for discovery and advertisement purposes only.

ClearMakaan is NOT a real estate broker, agent, developer, or RERA-registered entity. We do not buy, sell, rent, or transact in properties. We do not represent any builder or developer in an official capacity.

3. RERA Registration and Official Project Details

ClearMakaan does not independently verify, certify, or guarantee the accuracy of any project information, including:

• Unit dimensions, carpet area, or super built-up area.
• Floor plans, layouts, or unit configurations.
• Approved amenities, specifications, or construction timelines.
• RERA registration status, validity, or compliance standing.

Users are required to verify all material details directly on the official RERA portal of the relevant state before making any financial commitment or booking.

4. Pricing — Disclaimer and Update Policy

Prices displayed are indicative and subject to frequent revision. ClearMakaan does not guarantee the accuracy of any price shown. The actual price is determined solely by the developer at the time of booking.

To request a price update, email clearmakaan.com@gmail.com with the subject 'Price Update Request – [Project Name]'. ClearMakaan is not liable for financial decisions made based on displayed prices.

5. User Contact Information and Marketing Consent

By submitting your contact details, you expressly consent to:

• Communication via calls, SMS, WhatsApp, or email from ClearMakaan, channel partners, and developers.
• Receiving updates on new launches, price updates, and exclusive offers.
• DND Override: This consent is valid irrespective of your registration under the National Do Not Call (NDNC) or Do Not Disturb (DND) registry.

6. User Eligibility

You must be at least 18 years of age and legally competent to enter into contracts under the Indian Contract Act, 1872.

7. Acceptable Use and Prohibited Conduct

• No transmission of malware or harmful code.

8. Third-Party Content and External Links

We are not responsible for the accuracy of content submitted by third parties or the practices of external websites linked on our Platform.

9. Intellectual Property

All Platform content (name, logo, branding, software) is the exclusive property of ClearMakaan. Project images and brochures provided by developers remain their respective intellectual property.

10. No Brokerage, No Advisory, No Liability for Transactions

ClearMakaan shall not be responsible for any transaction entered into, financial loss, or dispute arising between a User and a developer/broker. Users are solely responsible for their own due diligence.

11. Limitation of Liability

To the maximum extent permitted by law, ClearMakaan's total aggregate liability shall not exceed INR 1,000 (Rupees One Thousand Only).

12. Indemnification

You agree to indemnify ClearMakaan against claims arising from your use of the Platform, breach of Terms, or violation of any law.

15. Governing Law and Jurisdiction

These Terms are governed by Indian law. Disputes are subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
